Terms and Conditions for Makers & Merchants Markets, ran by TGTT Events

Stall Site Allocation and Position

1. The Operator is solely responsible for allocating and positioning pitch sites.

2. If you have a specific request for a position change, you must contact the Operator at least 7 days before the event. We will do our best to accommodate requests; however, specific placement cannot be guaranteed as it depends on the venue layout and other traders.

3. Stallholders are not allowed to change their pitch position without prior consultation and approval from the Operator.

Setting Up, Closing Down, Loading, and Unloading

1. Stallholders must strictly adhere to the specified times and guidelines provided for each event for setting up, closing down, loading, and unloading.

2. Late arrivals may be denied entry to set up if the Operator determines that the stall will not be ready by the event's opening time.

3. Before leaving your stall site, stallholders must:

o Remove all rubbish.

o Ensure the stall site is left in the same condition as it was before setup.

4. Stallholders are responsible for removing and disposing of their own waste.

5. Non-compliance with these conditions may result in:

o Refusal of participation in future events.

o Immediate removal from the event if behaviour is deemed inappropriate or any agreed terms and conditions are violated.

Photography and Filming

1. Photography and videography will occur at all Makers & Merchants Markets, ran by TGTT Events, for promotional and archival purposes. These may include photos/videos of stalls and items for sale, which may appear on:

o Our website.

o Social media platforms.

o Promotional materials (e.g., brochures, magazines, and advertisements).

2. By participating, you acknowledge and agree to the following:

o Makers & Merchants Markets, ran by TGTT Events, has the right to use any photographs or videos taken during events without requiring additional written permission at any time after an event.

o These images/videos may appear in various media, including online and print formats.

3. If you do not wish to be photographed or filmed, please:

o Inform the event photographer and organisers directly.

o Contact us at [hello@makersandmerchantsmarkets.co.uk] in advance with a written request, including a photo for identification purposes (held in confidence).

4. By failing to notify us in writing or participating in the event, you release and hold Makers & Merchants Markets, ran by TGTT Events, harmless from any claims regarding the use of your likeness or images.

Stallholder and Visitor Disclaimer Makers & Merchants Markets, ran by TGTT Events, is committed to creating a safe and enjoyable environment. However, we remind all participants that:

1. Responsibility for Belongings:

o Stallholders and visitors are solely responsible for their belongings, merchandise, and personal items within the venue.

o The Market is not liable for lost, stolen, or damaged items.

2. Overnight Storage:

o The Market does not offer overnight storage or security for items left unattended. Leaving items overnight is done at the owner’s risk.

3. Security Measures:

o While we strive to maintain a safe environment, Stallholders and visitors are encouraged to take precautions to secure their belongings.

o Please report suspicious activity to Market staff or security personnel immediately.

4. Insurance:

o Stallholders should obtain their own insurance to cover merchandise, including potential loss or damage.

Liability and Event Participation

1. Participation at Own Risk:

o All participants (Stallholders, visitors, volunteers, and organisers) attend the event at their own risk. The Market is not liable for accidents, injuries, or losses incurred during the event.

2. Safety Precautions:

o While the Market takes measures to ensure safety, individuals must exercise caution, such as:

§ Avoiding tripping hazards.

§ Securing personal belongings.

§ Following traffic rules in parking areas.

3. Merchandise Quality:

o Stallholders are solely responsible for the quality and safety of the items they sell. The Market does not endorse or guarantee the quality or authenticity of any merchandise.

4. Event Cancellation:

o The Market reserves the right to cancel or reschedule events/venue due to unforeseen circumstances (e.g., inclement weather, natural disasters). Participants will be notified as soon as possible.

5. Refund Policy:

o Stallholder fee refund policies may vary by event. Stallholders should review the specific refund terms provided for their booking.

o Cancellations will be subject to a £10 admin charge for any cancellation, which will be debited from the amount refunded. By booking, you agree to give at least 14 days’ notice for stall cancellation and understand that any cancellation less than 14 days prior to the event will result in a 50% charge of the stall cost. Any cancellations within 7 days of the event will result in full stall charge with no refund due. Bookings are non-transferable.

6. Release of Liability:

o By attending, participants release Makers & Merchants Markets, ran by TGTT Events, its organisers, and affiliates from liability for injuries, accidents, or losses occurring during the event.

7. Rule Compliance:

o Participants must act responsibly and adhere to event guidelines and venue rules.

8. Terms Modifications:

o The Market reserves the right to modify or update terms and conditions at any time.

Additional Disclaimers

1. Makers & Merchants Markets, ran by TGTT Events, cannot be held liable for goods left overnight or any loss, theft, or damage to items during the event.

2. Any non-affiliated person or organisation may not use, copy, or modify Makers & Merchants Markets, ran by TGTT Events' photographs, videos, or materials without prior written permission from an authorised representative.

The safety of visitors, stallholders, contractors, volunteers and staff is the highest priority at all Makers & Merchants Markets events.

This policy outlines the procedures for monitoring weather conditions and managing risks associated with high winds, heavy rain, thunderstorms and other adverse weather.

The Event Manager has full authority to suspend, modify or cancel the event where conditions are considered unsafe.

The Event Manager is responsible for:

• Monitoring weather forecasts before and during the event.
• Carrying out dynamic risk assessments.
• Making decisions regarding event continuation.
• Communicating safety instructions to traders.
• Recording significant weather decisions.

All traders are responsible for ensuring their equipment is suitable, secure and maintained in accordance with the manufacturer's recommendations.

Weather forecasts will be reviewed:

• Seven days prior to the event.
• Daily during the week before the event.
• On the evening before the event.
• During setup.
• Throughout trading.

Where necessary, actual wind speeds will be measured using a handheld anemometer.

Decisions will be based on:

• Forecast conditions.
• Actual observed conditions.
• Manufacturer wind ratings.
• Site exposure.
• Public safety.

Forecast gusts below 20mph

Normal trading.

Requirements:

• Commercial grade gazebos only.

• Minimum ballast requirements.

• Routine inspections.

Forecast or observed gusts between 20mph and 30mph.

Additional controls:

• Increased monitoring.

• Check every gazebo.

• Remove feather flags and lightweight advertising.

• Remove gazebo sidewalls if required.

• Additional ballast may be required.

• Unsafe gazebos will not be permitted.

Forecast or observed gusts of 30mph or above.

A dynamic risk assessment will be undertaken.

The Event Manager may:

• Delay opening.

• Prevent gazebos being erected.

• Require gazebos to be dismantled.

• Allow trading without gazebos.

• Suspend trading.

• Close the event if safety cannot be maintained.

Forecast or observed gusts above approximately 35–40mph.

Unless it can be demonstrated that all temporary structures remain within their safe operating limits and public safety can be maintained, the outdoor event will normally be suspended or cancelled.

Every gazebo must:

• Be commercial grade.

• Be structurally sound.

• Be correctly erected.

• Be secured using suitable ballast.

Minimum ballast requirements:

3m x 3m gazebo

Minimum 30kg securely attached to each leg (120kg total).

Additional ballast may be required depending upon conditions.

The organiser reserves the right to refuse any structure considered unsafe.

Every trader must:

• Secure all stock and displays.
• Prevent equipment becoming airborne.
• Follow organiser instructions immediately.
• Remove unsafe equipment when requested.

Failure to comply may result in removal from the event without refund.

If weather conditions deteriorate:

Trading may be temporarily suspended.

Visitors may be directed away from affected areas.

Gazebos may be dismantled.

The market may close until conditions improve.

Public safety will always take priority over trading.

Makers & Merchants Markets reserves the right to postpone, suspend or cancel any event due to adverse weather.

No weather-related decision will be based solely on a forecast wind speed. Decisions will always consider actual site conditions, weather observations, manufacturer guidance, site exposure and the findings of the dynamic risk assessment.

The Event Manager's decision is final.

The safety of our visitors, stallholders, contractors, volunteers and staff is our highest priority.

Makers & Merchants Markets reserves the right to postpone, delay, suspend, modify or cancel any event, either before or during trading, where it is considered necessary to protect public safety or where circumstances beyond our reasonable control make it unsafe or impractical for the event to proceed.

All decisions will be made by the Event Manager following a dynamic risk assessment and with public safety as the overriding priority.

Weather conditions will be monitored in the days leading up to each event and throughout the event itself.

Decisions will take account of, but are not limited to:

• Weather forecasts.
• Actual weather conditions on site.
• Wind speeds and gusts.
• Site exposure.
• Manufacturer guidance for temporary structures.
• Advice from the emergency services or relevant authorities.
• The findings of ongoing dynamic risk assessments.

No decision to suspend or cancel an event will be based solely on a forecast wind speed.

Should adverse weather or any other unforeseen circumstance require the event to be suspended or cancelled after traders have commenced setting up or after trading has begun, no automatic refund, compensation or reimbursement shall be payable in respect of:

• Stall fees.
• Loss of earnings.
• Travel expenses.
• Accommodation costs.
• Stock losses.
• Damage to equipment.
• Any consequential or indirect financial loss.

By this stage, the majority of event operating costs have already been incurred, including venue hire, staffing, insurance, licences, marketing and operational expenses.

At its absolute discretion, Makers & Merchants Markets may choose to offer a goodwill credit or transfer to a future event where circumstances allow. Any goodwill gesture is entirely discretionary, does not constitute a contractual entitlement and shall not create a precedent for future events.

Where an event is cancelled before trader setup has commenced due to adverse weather or other circumstances beyond our reasonable control, Makers & Merchants Markets will, where reasonably practicable, offer one of the following:

• A transfer of the booking to a future event; or
• Such alternative remedy as the organiser considers appropriate in the circumstances.

The organiser reserves the right to determine the most appropriate remedy based on the specific circumstances surrounding the cancellation.

Makers & Merchants Markets shall not be liable for any failure to perform, delay, postponement, suspension or cancellation of an event where such action results from circumstances beyond its reasonable control.

Such circumstances include, but are not limited to:

• Severe or adverse weather, including high winds, storms, flooding, snow, ice or extreme temperatures.
• Fire.
• Pandemic or epidemic.
• Government restrictions or legislation.
• Emergency service advice or intervention.
• Terrorist threats or security incidents.
• Civil unrest.
• Utility failures.
• Venue closure.
• Industrial action.
• Acts of God.
• Any other event or circumstance beyond the reasonable control of the organiser.

In such circumstances, Makers & Merchants Markets shall not be liable for any direct, indirect or consequential losses suffered by traders arising from the postponement, suspension or cancellation of the event.

Nothing within these Terms & Conditions excludes or limits liability where such exclusion or limitation would be unlawful under applicable legislation. By booking a stall at any Makers & Merchants Market event you are ageeing with these Terms & Conditions. 

By booking a stall, traders acknowledge that outdoor events are inherently subject to changing weather conditions and accept that the safety of all attendees will always take precedence over commercial trading.

All traders agree to comply immediately with any instructions issued by the Event Manager relating to weather, health and safety, temporary structures or event operations.

Failure to comply with safety instructions may result in the trader being required to cease trading or leave the event without refund.

By submitting a booking and paying for a stall at any Makers & Merchants Markets event, traders confirm that they have read, understood and accepted these Terms & Conditions, including this Adverse Weather, Event Cancellation & Force Majeure Policy.

The Event Manager's decision in all matters relating to public safety and the operation of the event shall be final.

Outdoor markets are weather-dependent events. By confirming your booking, you acknowledge that you have read and accepted the Makers & Merchants Markets Adverse Weather, Event Cancellation & Force Majeure Policy. You understand that events may be postponed, suspended or cancelled where necessary in the interests of public safety, and that refunds, credits or transfers will be managed in accordance with this policy.
